Terms of Service

1. Who may use MakeEstore

You must be at least 18 years old, or have a parent's or guardian's permission, and be able to enter into a binding agreement. If you use MakeEstore for a business, you confirm you have the authority to accept these terms for that business.

2. What MakeEstore provides

MakeEstore is an online platform that lets you create and run your own online store: a product catalogue, stock and tax settings, orders and returns, coupons and flash sales, themes and Theme Studio, your own domain, delivery settings, bulk SMS, staff accounts and more. Which features you can use depends on your plan, as shown on our pricing page.

We keep improving the platform. We may add, change or remove features. Features marked "coming soon" are not available yet and may change before release. If we remove something important from a paid plan, we will tell you in advance.

3. Your account

• Give us accurate information when you sign up and keep it up to date.
• Keep your password and login codes private. You are responsible for what happens under your account, including actions by staff accounts you create.
• Tell us quickly if you think someone has used your account without your permission.
• You may not share one account between unrelated businesses or use someone else's account without permission.

4. Plans, fees and payment

• Free plan: you can run a store on the Free plan with no time limit, within the limits shown for that plan.
• Paid plans: prices are shown in Bangladeshi taka, per month or per year, on the pricing page. Invoices include VAT where the law requires it.
• 0% order fee: MakeEstore does not charge any commission or fee on your orders on any plan. You pay only your plan price.
• Other costs are separate and are your responsibility: fees charged by payment gateways, couriers, domain registrars and SMS providers, and SMS credit, which is bought separately.
• Changing plans: you can move to a different plan at any time. A change takes effect as shown in your dashboard. Features above the limits of your new plan may become unavailable.
• Price changes: we may change prices. A change does not affect a period you have already paid for, and we will tell you before it applies to your next period.
• Refunds and cancellation of paid plans are handled by contacting our support. We will publish a separate refund policy.

5. Your store and your responsibilities

Your store is your business. You are responsible for it, including:

• what you sell, how you describe it, and having any licences or permissions you need;
• delivering orders you accept, and handling returns, refunds and complaints fairly under the law and under the shop policies you publish;
• the information you collect from your shoppers, telling them how you use it, and keeping it lawful (see our Privacy Policy, section 5);
• your taxes and any records the law requires;
• the payment gateway keys, courier accounts and SMS settings you connect, and following the terms of those providers;
• sending SMS and other messages only to people who should receive them, without spam, and following the telecom and consumer rules that apply.

6. Rules for using MakeEstore

You may not use MakeEstore to:

• sell or promote anything illegal, counterfeit, stolen, or that you have no right to sell;
• cheat or mislead shoppers, including fake products, fake reviews or hidden charges;
• upload viruses or harmful code, or try to break, overload or get around the security of the platform or other stores;
• collect other people's data from the platform without permission;
• break someone else's copyright, trademark or privacy;
• send abusive, threatening or unlawful content or messages.

7. Content and ownership

You keep ownership of the content you put in your store, such as product details, images, logos and policies. You give MakeEstore permission to store, process and display that content only as needed to run your store and the platform. You promise that you have the rights to use it.

MakeEstore owns the platform, its software, themes, design and brand. These terms give you the right to use them to run your store while your account is open, and nothing more. If you send us feedback or ideas, we may use them to improve MakeEstore without owing you anything.

8. Third-party services

Some features connect to services we do not own, such as payment gateways (for example SSLCommerz, bKash and Nagad), couriers, SMS providers and domain registrars. Those services have their own terms and fees, and we are not responsible for how they work or for their downtime.

9. Privacy

Our Privacy Policy explains what information we collect and how we use it. Please read it. It is part of these terms.

10. Availability

We work to keep MakeEstore available, but we cannot promise it will always run without interruption or errors. We may pause the service for maintenance, upgrades or reasons outside our control. We try to give notice of planned downtime when we can.

11. Ending your use of MakeEstore

You can stop using MakeEstore at any time. The Free plan has no contract. For paid plans, contact support to ask about cancelling. You can ask for an export of your data before your account is closed.

We may suspend or close an account if you seriously or repeatedly break these terms, do not pay for a paid plan, put others or the platform at risk, or if the law requires it. When we can, we will tell you why and give you a chance to fix the problem first. After an account is closed, we handle your data as described in the Privacy Policy.

12. Our responsibility

MakeEstore is provided "as is" and "as available". To the extent the law allows, we do not promise that it will meet your every need or that your store will make a certain amount of sales.

To the extent the law allows, MakeEstore is not liable for indirect or consequential loss, such as lost profit, lost sales or lost data, and our total liability for any claim related to the service is limited to the fees you paid to MakeEstore in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.

13. If someone makes a claim

If a third party makes a claim against MakeEstore because of your store, your content or your breach of these terms, you agree to cover reasonable costs and losses that result, except where we caused the problem.

14. Governing law and disputes

These terms are governed by the laws of Bangladesh. If we have a disagreement, please contact us first so we can try to settle it in good faith. If we cannot, the courts of Bangladesh will have jurisdiction.

15. Changes to these terms

We may update these terms. We will change the "last updated" date, and for important changes we will give notice by email or in the dashboard. If you keep using MakeEstore after a change takes effect, you accept the updated terms.
